In this case, we advise you to take out the insurance offered by your carrier. BOW&Co SAS shall not be held liable in the event of loss, incorrect address or delay in delivery of a Product that you wish to return to the Site, insofar as the risks of transport that you choose and that you initiate lie solely with you. BOW&Co SAS undertakes to reimburse you the standard delivery costs including the tracking of the package. To this end, you should insert the delivery invoice indicating the tracking number of the package in your return package.

In the event of an exchange, the standard delivery costs of the first order will be refunded and the costs of the second delivery will be invoiced according to the delivery method chosen.

Under no circumstances will it be possible to give you an electronic credit that can be used on the Site, and the Site will not issue a customer credit to be used in a store.

We do not offer, for the moment, the possibility to request exchange or refund of BOW&Co Products purchased in a store from the Site.

11.1.b) Exchange

In case of exchange request, please specify in the dedicated field the Product(s) you wish to receive in exchange for your order.

If you would like the product(s) you have selected to be set aside for you, please contact our customer service department.

If the amount of the Product(s) chosen for replacement is greater than the amount of the Product(s) returned, you must pay the price difference in accordance with these General Terms and Conditions of Sale.

If the amount of the Product(s) chosen for replacement is less than the amount of the returned Product(s), the difference in price will be refunded to you by BOW&Co SAS (being reminded that for gifts, only the customer having bought the gift can ask for the refund and have his bank account re-credited) in accordance with the present General Conditions of Sale.

In the event of an exchange, the transport costs of the first delivery are reimbursed, but the transport costs of the second delivery are charged according to the delivery method chosen.

Please note that the exchange will take place within seventy-two (72) working hours from receipt of the product(s).

11.1(c) Reimbursement

In the event of a refund request, the refund will be made within seventy-two (72) working hours of receipt of the product(s). A confirmation e-mail will be sent to you. The refund, including the delivery charges of the initial order, will then be made according to the same method of payment used at the time of the order and will be made in the same currency as that used by the customer at the time of payment of his order.

Please note, however, that it may take up to ten (10) business days for your bank to process a refund on your card, depending on the processing time. This varies among card issuers, and we are not in a position to speed up this process beyond our control.

11.1.d) Gifts ordered from the bowandco.paris website

Third party beneficiaries of gifts ordered from the Site may exclusively exchange the Products via the procedure of

return to the Site. Consequently, only the customer having bought the gift will be able to ask for the refund within the framework of the right of retraction (insofar as only the bank account of the person having ordered the product can be re-credited).

If necessary, only an exchange for a Product of an equivalent or higher value (the price difference must then be paid by the third party beneficiary of the gift) is possible. The third party beneficiary will have to contact our Customer Service who will register the exchange and send by e-mail the prepaid return label.

12. Legal guarantees and commercial warranty

12.1. Legal guarantees

The Products sold by BOW&Co SAS are subject to the conditions of legal guarantees provided by articles L217-4 to L217-14 of the Consumer Code as well as articles 1641 to 1648 of the Civil Code, to the exclusion of all other guarantees:

- Legal guarantee of conformity :

BOW&Co SAS will deliver to you a Product in conformity with the contract and free of defects of conformity at the time of delivery of the said Product, in the sense that the Product will be fit for the use usually expected of a similar good and that it will have the characteristics presented at the time of sale. BOW&Co SAS is also liable for defects of conformity resulting from packaging, assembly instructions or installation when this has been charged to it by the contract or has been carried out under its responsibility. This guarantee will only come into effect if you request it within two years of the delivery of the property. Defects of conformity which appear within six (6) months from delivery shall be presumed to exist at the time of delivery, unless proven otherwise.

You can choose between the repair or the replacement of the Product unless one of these choices entails for BOW&Co SAS a manifestly disproportionate cost. If it is impossible to repair or replace the Product, you can either have the price paid refunded and return the Product or keep the Product and have part of the price refunded to you, unless the lack of conformity is minor. The return, replacement or refund of the Product will be made at no cost to you and does not preclude the possible allocation of damages in the event that you are entitled to them. The legal guarantee of conformity applies independently of the commercial guarantee indicated in Article 12.2 below.

- Legal warranty for hidden defects :

BOW&Co SAS will provide you with a Product free of hidden defects which would make it unfit for its intended use, or which diminish this use so much that you would not have acquired it, or would only have paid a lower price for it, if you had known about them. This warranty will only come into effect on the condition that you make the request within six (6) months from the discovery of the defect.

In the event of a latent defect, you will have the choice of returning the Product and having the price and costs incurred by the sale refunded to you, or keeping the Product and having part of the price refunded to you. In all cases, it will be up to you to prove that you meet the conditions of the guarantee.

In case of lack of conformity and hidden defects, you must return the Products to us at the following address :

BOW&Co SAS will nevertheless make its best efforts to satisfy its Customers in case of request for one or more spare parts.

14. Limitation of liability

Under no circumstances can BOW&Co SAS be held liable for any damage which does not result from a failure by BOW&Co SAS to fulfil one of its obligations.

15. Applicable law - Litigation

These General Terms and Conditions of Sale are governed and interpreted in accordance with French law. However, pursuant to EC Regulation 593/2008 of 17 June 2008, these general terms and conditions of sale do not prevent the application of a provision more favourable to the customer, which cannot be derogated from by agreement, and this under the law of the country where the customer has his habitual residence. In the event of a dispute relating to the application and/or interpretation of these General Terms and Conditions of Sale, the customer has the possibility of resorting to a conventional mediation procedure or any other alternative dispute resolution procedure.
